Information for consumers in distance selling contracts and customer information in electronic commerce contracts

1. Scope

The following General Terms and Conditions apply to the contractual relationship between us and the customer in the version valid at the time of the order, for orders placed via the online shop.

2. Conclusion of contract

The presentation of our products on the website merely constitutes an invitation to the customer to submit a binding offer.

By submitting an order, the customer makes an offer in accordance with the applicable legal systems:

  • France (primary): An offer may be revoked until it has been received by the addressee. If it is withdrawn before the stated deadline, this may be considered abusive conduct and give rise to liability for damages.

  • Germany (BGB § 145): An offer becomes binding once it is received by the addressee and can no longer be withdrawn thereafter.

  • Austria (ABGB): An offer may remain valid even after the death or incapacity of the offeror, unless otherwise specified.

The customer receives confirmation of the order by e-mail.

The contract is concluded when we accept the customer’s offer in writing or in text form within two working days after sending the order. The decisive point in time is when the customer receives the declaration of acceptance.

Working days and public holidays: A working day is any calendar day that is not a Sunday or a public holiday in the respective country.

  • France: 1 January, Easter and Easter Monday, 1 May, 8 May, 14 July, 15 August, 1 November, 11 November, 25 December, etc.

  • Germany: 1 January, Good Friday, Easter Monday, 1 May, Ascension Day, Whit Monday, 3 October, 25 and 26 December (additional holidays vary by federal state).

  • Austria: 1 January, 6 January, Easter Monday, 1 May, Ascension Day, Whit Monday, 15 August, 26 October, 1 November, 8 December, 25 and 26 December.

👉 Warehouses and logistics: national holidays of each warehouse location must be observed:

  • Poland: 3 May (Constitution Day), 11 November (Independence Day), etc.

  • Lithuania: 16 February (Independence Day), 6 July (State Day), etc.

  • France: as listed above.

3. Delivery, shipping costs, transfer of risk

Delivery is subject to the shipping costs stated in each individual case. If the customer is a consumer, we bear the shipping risk. If the customer is a business, the risk passes to the customer as soon as the goods are handed over to the logistics partner.

4. Retention of title

Delivered goods remain our property until the purchase price has been paid in full.

5. Payments

Only the payment methods displayed during the order process are accepted.

6. Liability for defects

Statutory liability for defects applies.

7. Consumer information in distance contracts and electronic commerce

a) Input errors can be identified and corrected before submitting the order using the delete and change functions.
b) Essential characteristics of the goods and the validity period of limited offers can be found in the product descriptions on our website.
c) The contract language is German.
d) Complaints and defect claims may be submitted to the address indicated in the provider identification.
e) The contract text is not stored by us and will therefore not be accessible to the customer after conclusion.
f) Information on payment, delivery and performance can be found in the offer.

8. Dispute resolution before a consumer arbitration board

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

9. Miscellaneous

The contractual relationship between us and the customer is governed by the laws of the Federal Republic of Germany. For consumers, mandatory statutory consumer protection provisions of the country of residence remain unaffected. The UN Convention on Contracts for the International Sale of Goods does not apply.

10. Data protection

Customer data is collected only for pre-contractual measures and contract processing, in compliance with legal requirements.

Liability for defects

  • New goods: Statutory liability for defects applies.

  • Used goods: Limitation period for claims for damages regarding injury to life, body, or health caused by intent or negligence remains unaffected. Liability under the Product Liability Act also remains unaffected. For consumers, liability for defects for used goods is limited to one year. For business customers, liability for used goods is excluded.
